Shropshire Council's strategic planning committee will discuss the scheme for land next to St Laurence's Church in Ludlow at its meeting tomorrow at 2pm in Ludlow Assembly Rooms.
Councillors voted against the plans at a meeting in January but the proposals were referred to the council's strategic planning committee.
Simon Buteux, who owns the Readers House next to the development, said the council faced "the very real prospect" of a judicial review as they believed it had acted improperly and unfairly.
Mr Buteux said: "Anybody who attended the planning meeting on January 26 could be left in no doubt that there is the resolve and the financial resources amongst the community to mount a judicial review if that is what is required."
But Ian Kilby, head of development management, said there had "not yet been a decision on this application to overturn or otherwise".
