Property confiscation proceedings halted against Whitchurch shopkeeper jailed over drugs offences
A crown court judge has decided that proceeds of crime proceedings will not be going ahead against a shopkeeper who is serving a jail sentence for supplying class A drugs.
Theodore Tobias Williams, 36, of Churchill Close, Newport, who owned a shop in Whitchurch was convicted on May 3 of possession with intent to supply class A drugs and sentenced to two years and six months.
Williams appeared at Shrewsbury Crown Court on Friday, November 1, where prosecutor Rosemary Proctor told Recorder Adrian Jack that it was considered that the case was considered no longer suitable for confiscation proceedings.
The Proceeds of Crime Act 2002 aims to prevent crime by confiscating assets obtained through criminal activity and cracking down on money laundering. POCA defines what constitutes criminal property and allows for the recovery of criminal assets through civil or criminal proceedings.
Recorder Jack allowed the POCA proceedings to stop but ordered the confiscation and destruction of drugs and paraphernalia.
