Judge Robin Onions said that although Butter had not taken the bat with him - he had found it when he walked into Mr Perry's home - the attack on Mr Perry as he lay in his bed was unprovoked and only a custodial sentence was appropriate. A Shropshire roofer who attacked a man with a baseball bat as he lay in bed has been sent to custody for eight months.Jason Butter, of Maer Lane, Market Drayton, admitted assaulting Phil Perry, causing him actual bodily harm, when he appeared at Shrewsbury Crown Court yesterday.

Mr Perry sustained 16 separate injuries, including swelling and bruising to his head and body.

Mr Steven Bacon, prosecuting, said Mr Perry had formed a relationship with Ashley Pennell, Butter's ex-girlfriend. He said Butter, 20, went to Mr Perry's home on August 27, at about 7.30am.

Butter entered the property, picked up Mr Perry's baseball bat and attacked him with it, while his victim was lying in bed and unable to defend himself.

The attack lasted about 30 seconds, until Mr Perry's mother managed to grab the bat from Butter.

Mr Daniel White, mitigating, said Butter was now reconciled with Miss Pennell, the mother of his young son, after a brief split.

He added that Butter was a hard-working man.
