A Powys man who failed a roadside breath test, but then failed to provide a specimen at the police station, has been given a community order
Benjamin Boucher, 42, was stopped in Brecon on February 13 2026, with police suspecting him of driving under the influence of alcohol.
Boucher, of Pencaedu, Newbridge-On Wye, failed a roadside breath test and was then taken to hospital, before later refusing to provide a further sample when requested to at the police station.
Boucher had previously denied failing to provide a specimen in April, but he entered a guilty plea to the charge when he appeared at Llandrindod Wells Magistrates’ Court on Tuesday, June 16.
Boucher, who was banned from the roads in May for 38 months for a separate drink driving offence, was told he would be sentenced at Merthyr Tydfil Magistrates Court with a pre-sentence report ordered.
Magistrates gave him a 12 month community order with 120 hours of unpaid work.
He was banned from driving for three years from June 16 2026 and he will have to pay £300 costs and a £114 surcharge.
