Daniel Kwietniowski was driving a Honda Accord when he was stopped by police in Weald Drive, Monkmoor, Shrewsbury, on December 13 last year, Telford Magistrates Court heard.

Ms Abigail Hall, prosecuting, said the police officer could smell alcohol on Kwietniowski and he was breathalysed.

It was positive and he was arrested and taken to Shrewsbury police station.

Ms Hall said he gave two more samples of breath and the lowest reading found he had 53 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35mg.

Kwietniowski, 33, who lives in Weald Drive, pleaded guilty to driving while over the drink-drive limit.

Miss Emma Lineton, for Kwietniowski, said that he had spent the day helping his brother.

She said: "Over the course of about six hours Kwietniowski had three to four glasses of wine. He thought the alcohol would have burnt off.

"He felt well and didn't believe himself to be over the legal limit."

She said he had driven about half a mile to his home when he was stopped by police.

Kwietniowski was also ordered to pay a £240 fine, £135 costs and £30 victim surcharge.
