Shropshire lorry driver faces retrial as double death crash court case is halted

The trial of a lorry driver who was involved in a crash in which an elderly couple died has been halted after the judge called for more evidence.

Recorder Graham Huston dismissed the jury in the case of Luke Smith and ordered a retrial once new expert evidence has been gathered.

Dennis Bennett, 82, and his wife Mavis, 84, from Albrighton died after their Renault Modus was involved in a collision with Luke Smith's Volvo lorry on October 25 last year on the A41 at Tong, near Shifnal.

Smith, 33, of Priory Way in St Georges, Telford, had denied two counts of causing death by careless driving.

The trial at Shrewsbury Crown Court was stopped yesterday after the jury heard a police interview with Smith in which he said thought he was travelling about 40mph.

The court heard later in the interview it was put to Smith that his vehicle was travelling at 56.5mph.

The retrial will be held in the new year.
