Father and son Kenneth, 39, and Jordan, 20, Mansell of York admitted assault at an earlier hearing and appeared at Shrewsbury Crown Court on Monday for sentence.

Judge Jim Tindal, who heard that it was the injured man, Gordon Riley, who had made the first move towards Jordan Mansell, said this had been a case of completely excessive self defence.

He gave Kenneth Mansell a 12-month jail sentence, suspended for two years, and ordered him to carry out 100 hours unpaid work.

Jordan Mansell, who had no previous convictions, was ordered to do 80 hours unpaid work.

Both men will have to pay £250 compensation and £100 costs.

The incident happened in Pontesbury, near Shrewsbury.

Judge Tindal said he accepted there had been a third man involved that had dealt the blows but had not been apprehended.

Mr Kevin Jones, prosecuting, said the incident happened in the street in Pontesbury one night in November 2015.

Poor CCTV footage showed men outside the party dressed in hi vis builders' jackets.

Mr Riley went over to Jordan Mansell who went down to the floor.

The CCTV then showed a third man, followed by Kenneth Mansell, joining in the melee.

Mr Riley suffered broken ribs and had to have six weeks off work, Mr Jones said.

Mrs Debra White for Jordan Mansell said her client had lain on the ground and not been involved in throwing punches or kicking.

Mr Paul Smith for Kenneth Mansell said his client had gone to the aid of his son.

"It was self defence that went over the top," he said.

Judge Tindal said the third person had had a greater involvement in the attack, but had never appeared before the court.
