Police found Martin Paul Boffey tucking into a late night snack next to his Boxster, in Colliers Way in Telford, where he denied all knowledge of the car.

But when officers spotted the fast food wrapper on one of the seats he confessed he had been driving and run out of petrol.

He tested at 46 microgrammes of alcohol per 100ml of breath - the legal limit is 35 microgrammes - and was arrested at the scene on August 23.

Boffey, 31, of Sheepwell Court, Ketley Bank, today pleaded guilty to drink driving at Telford Magistrates Court.

Prosecuting, Miss Kate Price said: "It was a Friday night, police officers could see the defendant stood against the railings with the vehicle parked behind him with no lights on.

"He was eating a burger and said he had been out at Frankie & Benny's and was now walking home. He denied all knowledge of the vehicle.

"But they found the wrapper of the burger he was eating inside the car. He said he was panicked and gave false details in error. He provided a positive breath test and was arrested.

"He later admitted he had driven the vehicle but had run out of petrol."

The court heard Boffey, the owner of a small telecommunications business, was waiting for a friend to bring him fuel when police approached.

Chair of magistrates Lynda Baker Oliver disqualified Boffey from driving for 12 months and ordered him to pay a £240 fine.

Boffey indicated he would like to take part in a drink driving course.

He was also ordered to pay £85 court costs and a £27 victim surcharge.
