Legal bid to overthrow council plan for Telford Asda site

The owners of Telford Shopping Centre have launched a legal challenge to planning permission which was granted for a new Asda superstore in the town.

At the Court of Appeal in London yesterday they claimed that if the plan went ahead it would take the supermarket and shoppers out of the town centre.

Telford Trustee No. 1 Ltd and Telford Trustee No. 2 Ltd, who own the shopping centre which has Asda as its foodstore “anchor”, are opposed to plans to build a new, larger Asda store on the site of Telford & Wrekin Council’s Malinslee House, just outside the centre.

The trustees, who have obtained their own planning permission for an Asda to be built on the Red Oak Car Park closer to the centre, are asking the Court of Appeal to quash the planning permission granted by the council for a store on the Malinslee House site.

They are concerned the council “raced through” Asda’s application and granted it within nine weeks in January 2010, only to then take nine months to grant them permission for their rival scheme in September, the court heard.

    It’s nonsense that a private company is allowed to “own” a town centre and then be in a position to prevent any competition. Let’s hope their Lordships in the court of appeal send them home with a raspberry and a hefty costs bill.

    Too right John, never liked that town centre, when they need to expand they use the car parks. Great way to get people to visit. But don’t forget that ASDA is owned by Wal-mart and over here when they build a new store they negotiate free taxes for up to ten years. This means that other businesses are paying Wal-mart’s taxes while being undercut by Wal-mart and finally going out of business. I’m a Wal-mart shopper, but I know I should not be as its not good for the local economy.

    So how can a landlord dictate where a tenant decides to move to, once they no longer want to stay in the original place.

    And even if this ludicrous challenege is successful, does the landlord think that Asda will want to stay where they are,!!!

    well i cant blame asda for wanting to move out of the centre and the owners have only themselves to blame as they were told quite some time ago that they would be moving out, the reason for them moving out was when the centre started raising the prices in the car park to stupid amounts, so all i can say is unlucky town centre look to yourselves and good for you asda
