Ex-Shropshire policewoman wins discrimination case

A police constable from Shropshire who quit the force shortly before being diagnosed with depression has won her case for unlawful discrimination.
Sarah Jane Hinsley, 37, of Broseley, had tried to retract her resignation when she realised her decision to leave had been as a direct result of her mental health condition.
But West Mercia Police denied this request because it had fallen outside the four-week notice period, solicitors acting for Mrs Hinsley said.
Toby Shergold, a West Mercia Police spokesman, today said: “West Mercia Police is currently considering its options following the ruling by the Employment Appeal Tribunal and as such is unable to comment further at this time.”
She took the force to tribunal for “failing to make reasonable adjustments” over her request for reinstatement but lost.
She appealed the decision and now the Tribunal has found the force liable for unlawful discrimination against a constable suffering with depression, an illness which can be considered a disability under the Disability Discrimination Act.
