Care dispute family to receive payout from Powys County Council

A Mid Wales family is to be paid £2,000 by Powys County Council after an Ombudsman’s report into their complaint about care payments.
A couple complained to the Ombudsman about their application for direct payments for their disabled granddaughter.
The report said the council’s “maladministration” led to the matter taking longer to sort than necessary and called for the payout and an apology.
It said: “Mr and Mrs A provide full-time care for their disabled granddaughter, Miss B. Respite care is provided by Miss B’s aunt.
“Mr and Mrs A complained about the manner in which the council had dealt with their application for direct payments for Miss B.
“They said that direct payments would enable them to provide care to Miss B in a more flexible manner.
“Instead Miss B receives care funding through the Independent Living Fund, which requires Miss B to attend day services.
“These are at set times every day and Mr and Mrs A stated that they and Miss B often find it difficult to attend. Mr and Mrs A also complained that the council should have offered direct payments to them, as Miss B’s guardians, while she was still a child.”
It said: “While the council should have offered direct payments to Mr and Mrs A when Miss B was a child, the Ombudsman concluded that this had not caused injustice to Mr and Mrs A,” it says.
“This was because, at that time, respite care was being funded by Children’s Services and it would not have changed the position for Mr and Mrs A once Miss B became an adult. There was no right to continue to receive direct payments. However, the Ombudsman found the council had failed to consider Miss B’s case appropriately.”
