Dad’s concerns after son ‘scalded by McDonald’s drink’

An urgent investigation has been launched by fast food giant McDonald’s after a Shropshire teenager was scalded by a cup of tea.

Ben LewisBen Lewis, 17, of Telford, said he bought the tea from the restaurant in Newtown in Powys but it was so hot that is blistered his skin when it spilt on his legs. He was left in need of hospital treatment.

His worried father Tony Lewis said if he had been a small child the consequences could have been much worse.

Today the fast food chain said it would be investigating what had happened.

A spokesman for McDonald’s, Marcus Crossman, said: “We are very sorry to hear of this accident and we will launch an urgent investigation to ensure our usual safety safeguards are in force.”

Ben, from Lawley, had been staying with his girlfriend Victoria Bennett in Newtown on Friday when they went to the Drive Thru at the town’s McDonald’s for some food.

He said that as Victoria drove away, her car hit a speed bump and the tea that he was holding spilt over his legs.

“The lid was obviously not on properly and the tea was incredibly hot,” Ben said.

Victoria took him to Welshpool Hospital where staff wrapped his blistered leg in transparent film to keep it sterile after applying a cream. “I was told to go back to make sure it was healing properly,” Ben said.

Mr Lewis said he was very concerned about the incident.

“The top on the cup obviously wasn’t fitted properly and the temperature of the water was far too hot,” he said.

“Ben’s scald is really nasty and if that tea had spilt on a small child the consequences could have been terrible.”

Ben said the scald had been so painful he had not slept at all on Friday night.

He also said that incident had meant he and his girlfriend had had to completely rearrange their plans for the weekend.

“I was going to go to Manchester on the train to meet up with my dad and go to the Wolves match. But because I was so worried about the blister I was too nervous to go on public transport,” he said.

    This happened to my son in the Telford Town Centre restuarant 7 years ago but all we got in apology was a £10 voucher, such an insult. We were offered the chance to go to court with 40 other cases but were asked for £500 each as an insurance incase we lost!

    Should have been more careful really – hot tea will burn when poured on skin – dont’ really think it is Maccy Dees responsibility to point that out any more than they have to point out the burgers make you fat!

    It’s a nasty accident, but at the risk of stating the obvious and repeating what Simon said above… tea is made with boiling water.

    As for the comment made by the father about a small child… small children shouldn’t drink hot tea and adults should be careful not to drink hot tea around children, in case it spills. Common sense.

    I don’t understand what McDonald’s are expected to do about it, but if they want to pay somebody to conduct the investigation then I’m happy to relieve them of a couple of thousand quid and tell them that the accident was caused by the accidental spillage of a beverage made with boiling water.

    Yes it is a nasty accident. Yes tea is made with hot water.
    McDonalds do have HOT on their cups.
    Also they do soft drinks and fruit shoots milk and orange juice so children would not be having a cup of tea from them. If the parent was then ot would be the parents responsibilty to keep an eye on it.
    Sorry to see what has happened but you cant cook cold as you cant do hot drinks cold either.

    This is so silly, McDonalds wouldnt have sold a cup of tea to a small child so you cant really compare!
    Also, would you write to the star if your mum made you a cup of tea and you spilt it? No of course you wouldnt so quit whinging!

    Can I just point out that when the incident happened with my son, McDonalds were using the polystyrene cups and in our case the cup crumpled from the heat of the tea and tipped over. The safety lid was on the cup but this also came away from the heat! People are NOT stupid they know tea is hot but it is very upsetting when your child has 3rd degree burns

    I do had a similar accident from starbucks, and yes I’m more than capable of drinking a hot drink. However, the paper cup became soggy, therefore when I picked the cup of the lid came off and I got covered.

    Don’t always assume – T speak explains the circumstances and it doesn’t sound like his / her son is at fault.

    Tea is hot. My three year old knows to be careful around hot drinks. This is similar to Liebeck v. McDonald’s Restaurants in the US where a 79 yr old woman bought a coffee and spilled it on her self. She then sued. McDonalds were held to be 80% responsible for her injuries. Thankfully, common sense prevails (to some extend) and in the UK, Bogle v. McDonald’s Restaurants Ltd where it was held “If this submission be right, McDonald’s should not have served drinks at any temperature which would have caused a bad scalding injury. The evidence is that tea or coffee served at a temperature of 65 C will cause a deep thickness burn if it is in contact with the skin for just two seconds. Thus, if McDonald’s were going to avoid the risk of injury by a deep thickness burn they would have had to have served tea and coffee at between 55 C and 60 C. But tea ought to be brewed with boiling water if it is to give its best flavour and coffee ought to be brewed at between 85 C and 95 C. Further, people generally like to allow a hot drink to cool to the temperature they prefer. Accordingly, I have no doubt that tea and coffee served at between 55 C and 60 C would not have been acceptable to McDonald’s customers. Indeed, on the evidence, I find that the public want to be able to buy tea and coffee served hot, that is to say at a temperature of at least 65 C, even though they know (as I think they must be taken to do for the purposes of answering issues (1) and (2)) that there is a risk of a scalding injury if the drink is spilled.”

    This brings back memories from about 20 years ago.
    I was was working in Telford and had a cup of tea
    from Mcdonalds.
    The tea was in a foam cup i had one sip and burnt
    my mouth it was painfull for days.
    People said “well what do you expect tea’s meant to be hot” well i drink a lot of tea and i certainley don’t like it cold.
    I have never had tea from Mcdonalds to this day.

    If the tea was served in a polystyrene cup, as T Speak says, then MacDonalds is definitely at fault. MacDonalds normally serves Tea, Coffee and Chocolate in cardboard cups. Polystyrene is only used for milkshakes, cola and other cold drinks. My deepest sympathy to Ben Lewis.

    I think you will find the tea at mc d’s is actually superheated to above boiling point, and if 7 above says, the cup melted then clearly it was too high….clealry it was too hot, even for a regular hot t.

    The tea would have to be less that 60 degrees C to be safe from hurting someone, which i assume at that point it would have been taken back to the restaurant becuase its too cold…

    and the cup was between his legs, therefore squashing the cup, lid pops off, not Mcdonalds fault in the slightest.
    I wish the british public would stop blaming everyone but themselves when something goes wrong.

    At our local McDonalds you have to sign a disclaimer prooving you knew that the tea can be hot.This has caused more queuing but only about 40% of customers now get burnt.Cold tea is available but costs slightly more as you dont have to wait in the disclaimer signing queue.

    Good grief – it’s an unfortunate accident that’s all. I’m an anti-capitalist but there’s no blaming McD’s for this one! One of the hazards of modern living I’m afraid…if people will drink hot drinks on the go then this is the risk. And with a speed bump up ahead??

    I personally witnessed Ben’s injuries and I can honestly say I was shocked and amazed at the severity of the burns to his legs. He is not a silly 17 year old and is a very responsible young man. This is actually what happened: Ben’s girlfrield passed the tea to him to hold in his hand. He did not have the tea in his lap at stated on a comment above. He actually was holding a Coke in one hand and the Tea in the other hand. As they drove away from purchasing their food and beverage they drove over a speed bump in Mcdonald’s car park and the tea spilt over his lap. May I point out the Coke he was holding did not spill a drop. The lid on the tea was not fastened on properly. Ben was in agony and went straight to the hospital were he was treated for his burns. The staff at the hospital could not believe that a cup of tea could cause such severe burns. I would like to point out to people who have commented above that we are all aware of tea being made from hot water but what non of the above seem to realise is that the extent of Ben’s burns and blisters on his legs could be caused by a cup of tea only. My question is how would some of the above people feel if it was their child, grandparent or a person with disabilities feel? I assume they wouldnt be very pleased either. By highlighting this case in the newspapers, Mcdonald’s etc will one create an investigation and two make people aware of how badly a person can be burned from a Mcdonald’s hot drink. Let’s all hope this doesnt happen again to anyone especially a vunerable person.

    hmmm, just to clear up a few things…where in the whole article did it state that i had the cup inbetween my legs?..nowhere, i was holding it with my right hand, with my coke in the left…after the speed hump the coke remained in my hand…coincidence? i dont think so.. was my girlfriend driving silly..no, as the speed hump was barely a few feet from the last window…unless she had a ferrari then the chance of breaking the limit in such a short distance is impossible…we were going no more than 5mph…lastly the lid was not on properly, so how is that my fault?…how would you feel if they served you a burger without the lid down?..would you eat it?…NO!

    i would also like to recommend that mcdonalds use a safer, sturdier cup in their drive thru section…and also ensure that dangerous contents is served with care and responsibility as i was very lucky that this happened to my leg and no my face.

    Ben, whilst any accident is very unfortunate, I believe that you are dealing with this in an extremly childish way (and in your response at number 23). Granted, if containers are not fit for the purpose by all means let the manufacturers/companies concerned know but don’t come on here with attitude. Your entitled to opinions (such as contacting the newspaper to tell them your story), but don’t get all shirty when people respond with counter critiscm. Personally I think it was foolish to take hot tea in a moving vehicle, what would have happened if it spilled on your girlfriends leg whilst driving?. I hope you have no lasting scars but hope you think a bit more next time aswell.

    I think McDonalds were 100% to blame. They should have served the tea complete with asbestos gloves and a heat resistant waterproof apron. Come on Ben, get a grip, hot liquids will burn, even small children know this. Next time perhaps a little more care or maybe take your feeder cup with you.

    ‘The lid was not on properly’, is the factually quoted comment from Ben. OK, so the lid was not on properly but you was in a moving car. It is your responsibility to make sure that anything on or in the car is secured safely. You did not check to make sure the lid had been securely fitted before the car moved away. Don’t go and blame McD’s for something that you did not do. Also, if the lid was not securely fitted, how did you manage to get the hot drink into the car without spilling any of it?. In my opinion it is another person looking to put the blame on someone else for there own failings.

    Im not sure if you did any science at school, but it is Physically impossible to heat water above 100 Degrees C! after this point it is steam, it CANNOT exist above this as a liquid, hence the term BOILING POINT.

    Funny how thousands of other people manage to drink tea/coffee from these guys every day with no problems!

    Strange that this “story” has also made national news, where this chap claims to be so badly injured he won’t be able to work for at least 2 weeks. Strangely, his injuries don’t prohibit him posing for photographers outside his local McD’s complete with tea cup.

    Grow up, get back to work, and stick to Happy Meals until you’ve learnt some common sense.

    How is ben to blame for the staff not putting the lid on properly? This is clearly their fault. And no it dont say it was between his legs. Its not going to kill mcdonalds to compensate for their mistake especially with the price they sell their 8p burgers for and the ridiculous money they earn, and only pay their staff for the one of the meals a day. I could understand if it was in their proper card cups and sealed which Is how I have recieved them. But for it to be in a polystyrene cup and lid not on properly is not his fault.

I live here in the USA and we have to deal with these morons on a daily basis . “I was scalded in the mouth by a hot apple pie ” . The clue is in the name you knucklehead ! “The tea burnt me because it was between my knees as i texted while changing a CD in my car while driving over speed bumps” Which bit of Darwinism in action don’t you get ?? People this stupid need , and i mean NEED , to be neutered to try and stop even more dough heads wasting oxygen ! Don’t let this level of moron start please . Ooops , to late .

    As a different contributor to the previous Simon I have little to add. McD’s have sold scoldingly hot take away drinks for many years. More recently in the geographic region of Shropshire they have provided a drive through facility at some venues. I don’t know if drive through was in place at the McD in question but speed bumps were clearly an issue that may have contributed to the accident. Sarcasm is a joy to behold. Would the sarcastic contributors be so smug if the person injured was a young child.

    The case in the US where the woman sued for millions and won came about because McDonalds were serving their coffee a few degrees above the temperature that they were legally allowed to.

    I’ve spilt freshly made coffee on myself before and that hasn’t even slightly burned me – for it to do that much damage the tea must have been significantly hotter than it should have been.

    If it was child in that seat instead of Ben and they were holding the drinks i’m sure it wold be a whole different group of responces, They should have been given a cup holder
    If the lid was loose then how could he have fitted it on properly with a coke in the other hand.
    Some one got hurt and by the looks of the photo’s it was very painful.

    I clicked on here to read the local “news” and as most commented, this came up!
    Having read through all of the comments i am astonished! This clearly is what the young man wnats is it not? attention, just like if a 2 year old falls over and you rush to them they make more of a fuss, you guys are giving him what he wants- attention! 17 going on 7 i think1??!!! If you are going to buy a hot- adult drink (rather than the childrens fruit shoots)you should prepare yourself for the consequenses in carrying said drink in a moving car! Not rocket science!
    Ben- i wish you no pain or discomfort but do think you need to be a tad more mature in future.

    Lesson: tea is hot, drinking hot drinks in the car might burn you….

    What people don’t get is that when you pour boiling water into a mug, a lot of heat gets absorbed by the china, so it starts cooling through the side. These paper-thin jobs don’t absorb the heat, the heat stays in the liquid, the lids and sides are frequently of different compounds and the heat makes them more flexible so the lids come off. And what the heck was a speed hump doing there anyway? Hope he and his girlfriend managed to ‘rearrange their whole weekend’ erm… can’t help there…

    Honestly, does nobody take responsibility for themselves any more?!
    Yes, the tea was scalding hot, just like it would be if you boiled a kettle at home to make a cuppa.
    So the dippy, underpaid staff member didn’t put a lid on properly (although you only state “obviously” so that seems to me to be an assumption you have made as to why it spilled)? You had just been handed a drink that you knew would be incredibly hot and were in a moving car. Surely common sense dictates that one of you checked it was secure before moving off?
    And I’m sorry, but by the looks of things most of the contents jumped out of the cup into your leg. How fast was your girlfriend going over the speed bump for that to have happened – the laws of physics would suggest perhaps a little faster than was safe considering you were holding a scalding hot drink! Even if the lid had not been on at all, it would take quite a bump to send so much liquid up and over the rim!
    Yes, it is very unfortunate what happened to you and I wish you a speedy recovery.
    But to go to the newspaper with such a pathetic, claims-are-us-esq agenda is just embarrassing.
    And shame on the Shropshire Star for even considering this was news! Here’s a newsflash for you – freshly brewed tea is scalding hot and just might injure someone if they spill it on them!

    Yes, there would have been. But then again no-one in their right mind would give a child a scalding hot drink to carry in a moving car, would they? And surely, wouldn’t any sensible adult, knowing they were about to set off in a moving car whilst carrying such an item might just consider ensuring that the lid was on properly before setting off?

    Then again, there are plenty of adults who don’t even put their seatbelts on before setting off. There’s simply no accounting for people’s personal attitude to risk.

    If course it would have been different if it were a child – it wouldn’t have spilled on the child because no fool would hold a hot drink in a car going over a speed bump anywhere near a child! Unless the child in question had a yearning for a cup of tea in which case it’s still a mute point because no one gives a child a hot drink to hold in a car! Hence no danger to a child where there is a hot drink in a car.

    This is why our insurance is so expensive nowadays, idiots claiming for things that with a tad of common sense could have been avoided. Seriously my 11yr old would know that a hot drink would need “nursing” if it was absolutely necessary to get a drink on the run. Ben your remarks make you sound even dafter than the story does!!

    If you are going to reject the cup holder they offer you, its your own fault! If they didnt offer, everyone knows they have them so why not just ASK for one?!! As for all these comments about “what if it was a child?”…well, if you are dumb enough to let your small child drink hot drinks in a moving vehicle, YOU and only you would be the one at fault. The fact is, you are a 17 year old who should have known ALOT better than to try and hold 2 drinks while in a moving car. A cup holder could have solved this problem. I get tea and coffee from newtown mcdonalds almost daily and have never had a problem like this before since the person at the window always offers a cup holder!! Now take your experience, learn from it and GROW UP!
