Litterer fined £465 for offence

A Telford man who dropped a drinks can in bushes has been left with a bill of £465.
Anthony Lord was spotted discarding the can near Hadley Health Centre in September last year.
The 46-year-old did not attend Telford Magistrates Court yesterday to face the charge that he dropped or left litter in an area off the High Street on September 9.
But the case, which was brought by Telford & Wrekin Council, was proved in his absence.
The court heard Lord was seen dropping the can by a community support officer.
He was issued with a fixed penalty notice of £75 but failed to pay it. The court heard the council wrote to him a further three times over the notice but he still did not pay the fine.
Magistrates ordered him to pay a fine of £150 as well as costs of £300. Lord, of Eyton Road, Dawley, will also have to pay a £15 victim surcharge. A fines collection order was also made.
Russell Griffin, a council spokesman, said: “This is by no means a first. There have been previous prosecutions brought by the council to address instances of littering including people caught dropping cigarettes, pint glasses and glass bottles.
“In cases of this nature, we issue an original fixed penalty notice for £75 with an early payment option of £50 in the first 10 days.
“We only bring a prosecution as a last resort and any penalties imposed are the decision of the court, not the council.”

It is good that people are being prosecuted for littering but the level of the fine is outrageous!

On the spot fines fixed at £450 should do it , but alas I see some slob empty the litter out of her car by around the village twice a week they are societys dregs.

According to the article on the BBC News web site, the man was observed littering by a community officer, who imposed a standard fine for littering. The man ignored the fine, and subsequent penalties for not paying on time, and by not attending court. He really has himself to blame, I have absolutely not sympathy whatsoever.

Sniper rifles on the rooftops would be more useful. See a litter lout, take him out. Our land will soon be much more pleasant. Except for the rotting corpses of course, but you cant have everything.

this is a joke ,if the telford and wrekin want to find people for littering ,tell them to stand out side the telford magistrates court where this man was to appear, where the scum that go in here drop fag ends and walking in court

I for one applaud this prosecution, but a) the fine is hugely disproportionate and b) I look in my Thesaurus and the entry “society’s dregs” is followed by “those who post needlessly inflammatory comments, with poor punctuation, and who usually need their computer confiscated. Antonym = winja”.

There does seem to be a lot of dregs in Andrew Finch society. The majority seem to be teachers, gritters, councillors or just people from whitchurch.

Donald, the fine is set proportionate to declared income and designed to hurt. This guy probably earns a good wage. Someone on benefits, for instance, may have been stung for a fraction of this amount. A Premiership footballer, by comparison, may have paid £3k for the same offence.

Aside from this – what about introducing financial incentives for people picking up litter? I regularly pick up litter, especially when on approach to a bin on a regular walking route. Am happy to do it without reward and others should be to but perhaps an incentive for a bag of rubbish collected and handed over? It’s amazing the difference you can make just walking down the street doing it…several people’s rubbish dropping can be undone in moments. Just a thought.

If only the council would please issue similar fines (or take up David’s suggestion and install sniper rifles) to sort out the lazy dog owners who allow their pets to use the pavements as a public lavatory??

If the fine had been acknowledged and disputed at the 1st instance that would have knocked of £75.00 straightaway – they can’t increase the fine for non payment if it’s disputed – other costs would still stand if you lost the dispute
Peter @ 16, I can assure you it has not been proportionately to income – for a start if there’s no court attendance or acknowledgement of the debt there can be no assessment of income

David. i like the sniper rifle idea, rotting corpses are alot more appealing that sitting in chewing gum on the bus or kicking a glass bottle you didnt see in the dark and some idiot shouts at you and tells you to pick it up. atleast with the corpses you can smile that some theres one less scum in the world.

He could have paid a £75 fine.
He chose not to pay it.
If he thought that he shouldn’t be fined, he had the opportunity to have his day in court and plead his case.
He chose not to turn up.
He was therefore found guilty and fined £150 (Not £465).
The extra £315 was for costs and the “victim surcharge”.
I think it’s only right that if someone is given the opportunity to pay a fixed penalty or have their day in court, and refuses to do either then they should, if found guilty, pay the costs that the public incurs as a result.

Peter—A lot of people on benefits are on a lot more money than some hard working people get paid.I know of some who have a couple of foreign holidays a year,and thats no waffle

The council may have issued a fixed penalty ticket and then written to him three times asking for payment. The Court may have issued a summons to appear and the court issued a fine plus costs plus victims surcharge. But did the litter dropper give his real name and address? The council official cannot torture the real name and address from anyone nor arrest you if you have no ID on you.

Again, notwithstanding the illiterate smell from this comment, what really stinks is the assertion that those that litter (presumably, the scale of the crime doesn’t matter) are “scum”. Should that term not be reserved for Hitler / Pol Pot / Ceaucescu / Mengele?
I think, raadec, you need to get a sense of bloody perspective.

This man had every opportunity to pay the basic fine. Not only does he not care in the slightest about his environment but he chooses to ignore the legal responsibility on him to deal with the fine – either by paying it or opting for court. He then chooses to ignore the subseqent summons – serves him right. He should have just paid the ticket – or even better still not dropped the litter in the first place. He only has himself to blame and lets hope he has learnt something from his ‘experience’….

as someone as already quoted about the fag ends just look at them on the floor as you walk into the bus station at ttc and what about those who smoke by the doors and outside there areas fine them £450
as about this it was’nt his litter it was litter before he touched it, he should of given a false name and address like loads do on trains when they get caught with no ticket
