Council to press on with work ban

Council planners are to press ahead with court action against a 69-year-old man after time ran out for him to stop work on a house he is building in a Shropshire village.

Telford & Wrekin Council slapped an enforcement notice on John David which ordered him not only to cease building work on the house in High Street, Coalport, but also to make a list of changes to the structure.

A deadline for Mr David to comply expired at midnight on Saturday and the council today said it would proceed with taking him to court.

The pensioner does, however, have a right of appeal against an earlier decision to refuse him retrospective planning permission for the work.

He has until February to lodge such an appeal and if he does the council prosecution will be put on hold.

The enforcement notice was issued because the council claims Mr David is not building the home in line with the planning permission he was given.

A Telford &Wrekin Council spokesman said: “We are now proceeding with a prosecution and will be taking the matter to court to get the notice enforced.

“If, at any point between now and February, he appeals against the retrospective planning permission he was refused earlier the proceedings will be put on hold until such time as the appeal is heard.”

Mr David was unavailable for comment today.
