Victory for eBay over L'OrealThe online auction site eBay has won a high court case against the cosmetic firm L’Oreal.

A judge in London ruled that eBay was not jointly liable for trademark infringements committed by its users.

L’Oreal had claimed eBay was liable for counterfeit goods sold on the website, breaching the company’s trademark.

The cosmetic firm claimed the auction site had put consumers at risk by failing to stem the sale of fake products and actions taken to stop counterfeiters were ineffective.

The website countered, however, saying it has no direct involvement in the sale of goods, simply providing a trading platform.

After today’s ruling, Richard Ambrose, eBay’s head of trust and safety, said: “This is an important judgment because it ensures that consumers can continue to buy genuine products at competitive prices on eBay.

“As such, it is a victory for consumers and the thousands of entrepreneurs who sell legitimate goods on eBay every day.”
