Villagers eye court move to block kennels

Campaigners against plans to site hunt kennels in a Shropshire village may apply for a judicial review in a bid to block them. The No Hunt Kennel campaign is challenging the relocation to Whixall.

It has issued a pre-action protocol letter to the district council.

The authority gave planning consent for the North Shropshire Hunt kennels to move from Preston Brockhurst.

Opponents say the letter gives NSDC a chance to respond to questions relating to its conduct of the planning process, before the case is taken before a High Court judge in an application for judicial review.

A campaign spokesman said: “It is NSDC’s adherence to protocol and their own policies that is being challenged in this action.

“That they chose to be so inconsistent and erroneous in their approach to the second application is incredible in the light of the levels of objection that NSDC received to both the hunt’s planning applications.

“The hunt continues to claim that there is lots of support for relocating their kennels to the Whixall area.

“The public meetings hosted by Whixall and Wem Rural parish councils, the 126 letters on file objecting to the second application, and the 138 names on a petition backing those that spoke out against the development on the community’s behalf at the development control committee in September when the permission was granted, would seem to suggest otherwise.”

Campaigners say a court win would see the consent quashed. The council, said it had received the letter and was reviewing its position.
