Speed officer to fight conviction

He claims the conviction could seriously hamper the work of thousands of police officers, firefighters and ambulance drivers all over the country.

Constable Milton, of Bratton, Telford, was found guilty of dangerous driving at Ludlow Magistrates Court in August for trying out his new Vauxhall Vectra at 159mph on the M54 and 83mph in built-up areas.

He was given an absolute discharge by District Judge Peter Wallis, who did not order Constable Milton to pay a fine or endorse his driving licence with any points.

Constable Milton immediately lodged an appeal against the conviction.

His solicitor Mr David Twigg said today that they would continue challenging the conviction on a point of law, which could see it go back before the High Court in London.

Mr Twigg said: “The appeal is now by way of case stated to the High Court.”

He said they were questioning the point of law used to convict Mr Milton.

Mr Twigg, who represented Mr Milton in his first trial and the four-day re-trial, added: “It doesn’t just affect Mark, it affects every fire brigade, police and ambulance driver, every specialist trained driver.”

Mr Pat Sullivan, prosecuting, said the constable had been driving at “eye-watering speeds”. Constable Milton claimed he had been honing his skills after an advanced driving course.
