Train crash driver spared jail

A scrap metal dealer from Shropshire whose lorry was hit by a train after he drove it on to a level crossing without permission was today spared jail.

Arthur Roberts, 45, appeared at Welshpool Magistrates Court for sentencing today after admitting breaching level crossing laws.

The court heard he drove on to an unmanned crossing at Buttington, Powys, without phoning for permission as required, on September 10. 

His lorry was then struck by an Arriva Train Wales service from Birmingham to Aberystwyth.

One person needed treatment for cuts and bruises.

Roberts, of Cherry Tree Drive, St Martins, was given a four month jail term, suspended for 12 months, and ordered to carry out 150 hours of unpaid work and pay £60 costs.
