Ground bosses consider licence ruling appeal

West Mid showground bosses who were slapped with a raft of conditions on their new licence today said they were considering an appeal or other legal action.

The Shropshire and West Midlands Agricultural Society will meet with its lawyers on Monday to discuss the next step forward after councillors imposed more than 40 conditions, including installing noise limiters in the pavilion

Chairman David Tudor said: “Although the new licence offers more flexibility than the present one and will give us much more flexibility for events on the showground, the society does not accept the raft of additional conditions imposed by the environmental health department of SABC.”

Conditions state the society should hold a residents’ forum at least four times a year but Mr Tudor said he refused to hold meetings because of the alleged behaviour of some residents.

He said: “Such meetings, which I have held three times per year since I became chairman to hold sensible dialogue with neighbours, will not happen again during my chairmanship or that of my successor.”

He added: “In a higher court it is almost certain that the vast majority of these 40 conditions would be overturned - many are not part of the licensing law of this country - and we will await the recommendation from our lawyers concerning further action.” But Mr Tudor said it did mean the fireworks display which had to be cancelled last November because of problems with the licence will go ahead this year.

Carol Foster, licensing officer for SABC, said: “A number of the conditions were offered by them in their operating schedule and members have taken those on board.

“The other conditions closely follow those conditions attached to other premises licences that have been granted.”
