Club’s bosses deny 50 breaches

The Buttermarket, Shrewsbury Two bosses of a Shrewsbury nightclub today denied a total of more than 50 breaches of licensing conditions on the night a gunman opened fire at the premises.

Police launched an investigation after hundreds of terrified revellers fled for safety when the gunman apparently opened fire on the dancefloor of The Buttermarket in the early hours of June 23, 2007.

The Howard Street club was investigated after 24-year-old Daniel Maxwell, of Telford, was reportedly shot in the arm.

Appearing at Shrewsbury Magistrates Court today, Shaun Michael Anthony Le Dain, designated premises supervisor of the club in Howard Street, denied 26 breaches of its licensing conditions and premises licence.

Kerry Wycherley, licence holder of the club, who was not present at today’s hearing, also denied 26 similar charges through his legal representative Mr Dean Easthope.

The pair face charges including failing to ensure that fire escapes were free from obstructions and that the access to the emergency exit on the ground floor cloakroom was compromised by items such as a steel desk, cleaning equipment and ladders.

They are further charged with failing to ensure that gangways and stairways were kept free from obstruction. They are also accused of failing to notify Shrewsbury and Atcham Borough Council as licensing authority that the layout of the premises did not conform to the plan in authorisation.

The case was adjourned for a trial date to be fixed.

In December Mr Wycherley won half of his legal costs back from the borough council following an appeal over conditions imposed after the shooting.
